Stallings Estate Sues County and North Grading
Another Breaking Story by The Information Age
by D. Tim Clark
February 25, 2010
A little over a month ago, the estate of former Carrollton Mayor and State Representative Tracy Stallings put the Carroll County Board of Commissioners on notice regarding "damages caused by the County and its agents .. to the building .. located at 201 Newnan Street." In a letter dated January 22nd, 2010, the estate warned:
"If the County fails to provide just compensation to the Estate within 30 days, the Estate will initiate legal action to recover its damages."
And true to their word this afternoon, the Stallings' Estate filed a lawsuit against Carroll County, Georgia and North Grading & Clearing. North Grading was the county's agent hired to demolish the Courtyard Square buildings which were attached to the Stallings' Building.
Building Recently Renovated The suit begins by describing a recent renovation to the building, a project completed shortly before Tracy Stallings purchased the property.
Court-filed documents also describe damage done to the Stallings' building; blame is placed on the 2 defendant organizations; and affidavits are attached to complete the package.
Smoking Gun? An affidavit included from Professional Engineer Thomas J. Wiener is particularly damning while pointing to at least one smoking gun in the demolition of the attached Courtyard Square structures:
"In my professional opinion, Courtyard Square should not have been demolished with the use of a wrecking ball.
In my professional opinion, using a wrecking ball to demolish Courtyard Square was the worst possible demolition means with regard to preserving the Building's structural integrity."
